Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Wildwind Co., Ltd. ("Wildwind", "we", "us", or "our"), a company incorporated under the laws of Japan, governing your access to and use of Maia: Meltdown and any related websites, software updates, and services (collectively, the "Service"). By installing, launching, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not install or use the Service.

IMPORTANT: Section 15 contains a dispute resolution clause. EU/EEA and UK consumers retain all mandatory statutory rights regardless of that clause. Please read Section 15 carefully.

Governing Language: These Terms are published in English and Japanese. Where there is any conflict, the Japanese version prevails for users in Japan; the English version prevails for users in all other jurisdictions.

1. Eligibility and Accounts

1.1 Age Requirements

You must meet the minimum age required by applicable law in your jurisdiction to use the Service. For reference:

United States and most other jurisdictions

13 years. Under 13 is strictly prohibited (COPPA).

If consent is required, the registering user represents that their parent or legal guardian has reviewed and agreed to these Terms. Wildwind may request evidence of consent at any time and may suspend or terminate accounts pending verification. Accounts belonging to users below the applicable minimum age will be terminated and associated data deleted.

1.2 Account Registration

You agree to: (a) provide accurate and current registration information; (b) maintain the confidentiality of your login credentials and not share them with any third party; (c) take responsibility for all activity occurring under your account; and (d) notify us immediately at admin_EN@wildwindstudio.com if you suspect unauthorised access. Each user may hold only one active account unless Wildwind grants express written permission otherwise. Accounts are personal and non-transferable; you may not sell, gift, lend, or otherwise transfer your account.

1.3 Account Inactivity

An account that has not been logged into for three (3) consecutive years may be designated as inactive. Before deactivating such an account, Wildwind will send at least one email notice to the registered address. Deactivated accounts and associated data will be deleted in accordance with our retention policy. Any unused Virtual Items or in-game currency associated with a deactivated account will be forfeited, except where applicable law requires otherwise.

1.4 Account Name Policy

Usernames and display names must not contain obscene, offensive, discriminatory, politically inflammatory, or otherwise objectionable content as determined by Wildwind in its reasonable discretion. Wildwind may require a name change and may suspend the account pending compliance.

2. Licence to Use the Service

Subject to these Terms, Wildwind grants you a limited, personal, non-exclusive, non-transferable, freely revocable licence to install and use one copy of the game client on a device you own or control, and to access and use the Service for your personal, non-commercial purposes only. This licence does not include the right to:

3. Software, Updates, and System Requirements

Your device must meet the minimum system requirements published on our official website. Wildwind does not warrant compatibility with all hardware or software configurations. You are responsible for any internet service provider charges arising from your use of the Service.

Wildwind may issue updates, patches, or new versions of the Game Software at any time. Some updates may be applied automatically to maintain security, stability, or regulatory compliance. By using the Service, you consent to such automatic updates. Where we distribute the Service through third-party platform stores (e.g. Steam), the platform operator's subscriber agreement applies alongside these Terms.

4. Anti-Cheat and Fair Play

To protect the fairness and integrity of the Service, Wildwind deploys anti-cheat software that operates in the background during gameplay. By using the Service, you consent to such monitoring, strictly limited to activity directly related to the Game Software. The following conduct is strictly prohibited and may result in immediate account suspension or permanent ban:

Wildwind's determination of what constitutes a violation is final, subject to appeal. Bans may be appealed within 30 days of the action by contacting admin_EN@wildwindstudio.com.

The Service may allow you to submit content such as screenshots, profile information, forum posts, or in-game creations ("User Content"). You retain ownership of User Content you create. By submitting User Content, you grant Wildwind a royalty-free, worldwide, perpetual, sublicensable licence to use, reproduce, modify, distribute, and display that content in connection with operating and promoting the Service.

You represent and warrant that: (a) you own or have sufficient rights to your User Content; (b) it does not infringe any third-party intellectual property or privacy rights; and (c) it complies with these Terms and applicable law. Wildwind may remove User Content that violates these Terms without prior notice.

7. Wildwind Content and Intellectual Property

All elements of the Service — including game engine, source code, artwork, music, character designs, storylines, trademarks, and logos ("Wildwind Content") — are the exclusive intellectual property of Wildwind or its licensors. Nothing in these Terms transfers ownership to you. Unsolicited ideas, suggestions, or feedback you submit to Wildwind may be used freely by Wildwind without compensation or attribution.

8. Virtual Items and In-Game Economy

8.1 Nature of Virtual Items

The Service may include virtual currency, items, and other digital goods ("Virtual Items"). Virtual Items are licensed to you, not sold. They exist solely within the Service and carry no real-world monetary value. Virtual Items cannot be redeemed for cash from Wildwind or any third party.

8.2 Purchases and Refunds

Purchases of Virtual Items are generally non-refundable once completed.

EU / EEA consumers: Under the EU Consumer Rights Directive, you have a 14-day right of withdrawal from digital content purchases. However, by confirming your purchase and consenting to immediate access, you expressly waive your right of withdrawal once delivery has begun. If you do not consent, do not complete the purchase.

Refunds may also be available where required by mandatory consumer protection law in your jurisdiction. To request a refund, contact admin_EN@wildwindstudio.com.

8.3 Billing

All payment information must be accurate and current. You are responsible for any applicable taxes arising from your purchases.

9. Service Modifications, Termination, and Shutdown

Wildwind may modify, suspend, or discontinue any aspect of the Service at any time. In the event of a permanent service shutdown, Wildwind will provide at least 30 days' advance notice. Any outstanding balance of prepaid in-game currency will be addressed in accordance with applicable law in your jurisdiction.

Wildwind may terminate your account immediately for material breach of these Terms, fraudulent conduct, or where continued access poses a risk to other users or the integrity of the Service. Upon termination, your licence ends immediately and you forfeit any associated Virtual Items and in-game progress, except where applicable law requires otherwise.

10. Force Majeure

Wildwind shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, government action, pandemic, power outages, or internet or telecommunications failures ("Force Majeure Events"). Wildwind will use commercially reasonable efforts to resume performance as soon as practicable following any Force Majeure Event.

11. Marketing Communications

We will only send you marketing communications with your prior consent. You may withdraw consent at any time by clicking the unsubscribe link in any marketing email or by contacting admin_EN@wildwindstudio.com. Opting out of marketing communications does not affect essential service communications, which we may send without separate consent.

12. Privacy

Your use of the Service is subject to our Privacy Policy and Cookie Policy, each incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in those policies.

13. Copyright

Wildwind respects intellectual property rights and complies with applicable copyright laws including, where applicable, the US Digital Millennium Copyright Act ("DMCA"). If you believe that content on the Service infringes your copyright, please send a notice to:

Your notice must include: (i) identification of the copyrighted work claimed to have been infringed; (ii) identification of the allegedly infringing material and its location within the Service; (iii) your contact information; (iv) a good-faith belief statement; and (v) a statement under penalty of perjury that the information is accurate. Repeat infringers will have their accounts terminated.

14. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WILDWIND DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WILDWIND'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO WILDWIND IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) USD 70 (OR THE EQUIVALENT IN YOUR LOCAL CURRENCY AT THE PREVAILING EXCHANGE RATE AT THE TIME OF THE CLAIM).

Nothing in these Terms limits any warranties or remedies that cannot be excluded or limited under applicable mandatory consumer protection law.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Japan, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15.2 Governing Language

Where there is any inconsistency between the English and Japanese versions of these Terms, the Japanese version prevails for users in Japan; the English version prevails for users in all other jurisdictions.

15.3 Informal Resolution

Before initiating any formal proceedings, please contact us at admin_EN@wildwindstudio.com and attempt to resolve the dispute informally. We will respond in good faith within 30 days.

15.4 Arbitration

If informal resolution fails after 30 days, any claim, dispute, or controversy (excluding requests for injunctive relief) between you and Wildwind shall be resolved by binding arbitration administered by the Japan Commercial Arbitration Association (JCAA) under its Commercial Arbitration Rules, conducted in Tokyo, Japan. The arbitrator's award shall be final and enforceable in any court of competent jurisdiction. Contact the JCAA at https://www.jcaa.or.jp.

EU / EEA and UK consumers: The arbitration clause above does not deprive you of any mandatory rights under the laws of your country of habitual residence, including the right to bring proceedings before your local courts and to access applicable ADR schemes.

15.5 Individual Claims Only

All claims must be brought in your individual capacity. To the fullest extent permitted by applicable law, neither you nor Wildwind may participate in class action, collective, or representative proceedings. This provision does not apply where prohibited by applicable law, including in EU Member States and the UK.

16. General Provisions

(A) Assignment: You may not assign these Terms without Wildwind's prior written consent. Wildwind may assign or transfer these Terms, in whole or in part, to any affiliate, successor entity, or acquirer — including in connection with a corporate restructuring, change of operating entity, or transfer of the Service to an entity within the Wildwind group — without restriction and without prior notice to you.

(B) Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Wildwind regarding the Service.

(C) Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.

(D) No Waiver: Failure by Wildwind to enforce any right or provision does not constitute a waiver of that right or provision.

(E) Amendments: We may amend these Terms at any time. Material changes will be communicated at least 14 days before they take effect. Continued use constitutes acceptance.
